Now, if we ponder every possible avenue by which Paul Nungesser could (a) vindicate his reputation, (b) possibly collect a large cash settlement, and (c) deliver a brutal payback to Sulkowicz for her effort to destroy him, I doubt he could have done better than what he has done: Instead of suing Sulkowicz, he sues Columbia. Why?
- Columbia’s endowment is reported at $9.2 billion — that’s billion with a “b” — which means they may (and probably should) decide that quietly paying Nungesser a couple of million bucks is a small price to pay for ridding themselves of this bad publicity.
- Suing Columbia calls attention to how the university violated its own policy by permitting Sulkowicz to breach the confidentially requirements of the university’s sexual misconduct hearing process and, indeed, by endorsing this breach through Professor Kessler’s role in Sulkowicz’s “performance art” project.
- Most of all, by not naming Sulkowicz as a defendant, this means that Sulkowicz does not have cause to respond to the allegations he makes against her in the Columbia lawsuit, and guess what? You can’t be sued for defamation because of allegations made in a lawsuit.

You don’t send a message by going for small payouts as punishment. Even if he doesn’t win all $10 million in court, he’ll put the fear of financial hardship on endowment organizations. The case against the school hinges on the professor encouraging the harassment mattress carrying. That professor WAS the University (see also respondeat superior) and she violated the dudes civil rights- starting with the presumption of innocence- and it caused him damages. He is going to win but it will settle in the hundreds of thousands, not millions. If it goes to trial the jury can find there were no monetary damages (since the publicity et al is likely to turn out to a net economic benefit to him by the time of trial) but they could still award millions of dollars in punitive damages.

Did you read the rest of my comment? I agree that she could not prevail, and I think that you are right that she would not really get started. She would have a difficult time even retaining a lawyer willing to represent her. Under Rule 11 of the Federal Rules of Civil Procedure (which are more or less copied by all 50 states) a lawyer may be punished for signing any pleading without a reasonable examination of the law and the facts, and can be liable for the expenses incurred by the other party in responding to a baseless claim. The fact that everything she says is bullshit doesn’t necessarily mean her lawyer would lose, but I damn sure wouldn’t run that risk. She could represent herself and at least get before a judge, but that’s not what she wants. She won’t tell her story to anyone she doesn’t already know will credulously repeat it as truth, ignoring all evidence to the contrary.

I think he may well still sue her, if he thinks he can get anything. But the claims against Columbia are very very different than the claims against her, so bringing them together could be a distraction.
The claims against her would mostly be based on defamation. But truth is always a defense to that. So, if he names her in the same proceeding as Columbia, then they have to relitigate whether what she is claiming is true – namely, that he raped her. That would be a massive distraction in the context of his Title IX claims against Columbia.
In suing just Columbia and the professor, the falsity of her claims would seem to be a given. Columbia already acknowledged and adjudicated the claims as false on two occasions. How can they now create a distraction by relitigating that?

Off topic, but regarding your search for a faithful Catholic wife, try Coeur D’Alene. I think part of the issue here is that rape is a crime that trumps all other crimes. A rape accusation is equivalent to being an Enemy of the State.
Expect all Enemies of the State to end up with trumped-up rape charges.
Another point to add what John is saying…most of what is shown is in fact a fantasy or illusion. Fantasy can give you tingles you think translates to the flesh and blood world we live in but it doesn’t show the resultant shame or mental illness that comes after from acts like that. Namely because they aren’t the proper use of the function to begin with. You might try to rationalize it away…but your heart and body knows.

Indeed, I know a guy who’s now sexually oriented towards cartoon-looking characters (anime I guess). So he has struggles being attracted to real-life women. And he’s not exactly super high on the attractiveness scale himself.
It would help young men to quit watching TV and movies that glorify a lifestyle of fornication without showing them any of the consequences that result from sky-high partner counts, or the mental problems that accrue from pursuing hours of pornography and masturbation each day.
I didn’t realize how bad the anime thing was until I saw some guys glorifying it on twitter. Granted porn is sick…but that’s a higher level away from reality of sick when you have guys addicted to animated female characters.

Yeah, but thats historical, the reason rape was so abhorrent was that it could kill the women at the time (internal bleeding) or during the pregnancy or possibly at childbirth, so she could easily die months later due to some lunatic.
Also, if she survived all that, there was a child that no-one wanted to care for leading probably to its death as well.
In short, rape used to equal alot of death all round, particularly for the perpetrator. That sense of punishment is still carried down the ages even with the morning after pill + medical treatment, adoption agencies etc.

A biblical position is to just not care about crime.
What matters is sin.
I could give two whits what man’s governments think a “crime” is. I do care quite deeply about sin.
And the Bible lays out fornication as a grievous sin.
